GENERAL BACKGROUND

Under the applicable law, and in accordance with the terms of the Agreement between the United Nations and the Royal Government of Cambodia, the Extraordinary Chambers in the Courts of Cambodia (ECCC) has jurisdiction to try senior leaders and those who were most responsible for the crimes and serious violations of Cambodian penal law, international humanitarian law and custom, and international conventions recognized by Cambodia, during the period of the Khmer Rouge regime from 17 April 1975 to 6 January 1979.

While the ECCC is established as a national Court, the Royal Government of Cambodia sought the technical assistance of the United Nations in operating the court. In Resolution A/57/228 and A/57/228B, the General Assembly approved the involvement of the United Nations and endorsed the agreement outlining the arrangements between the two parties. The United Nations Assistance to the Khmer Rouge Trials (UNAKRT) was established in 2005 to provide on-going technical, operational and logistical support to the Royal Government of Cambodia in all aspect of the Court's operations.

OBJECTIVES OF THE ASSIGNMENT

This assignment is necessary in view of the overall goal of delivering the final submissions in at least two investigations (and possibly three) by the end of 2017, in accordance with the latest version of the ECCC Completion Plan. In view of this, and in view of the heavily factual nature of all of these filings, the Office of the Co-Prosecutors will need the services of the Legal Consultant for a period up to 2 months.

SCOPE OF WORK

Under the direct supervision of the Deputy Co-Prosecutor, and the overall supervision of the International Co-Prosecutor, the Legal Consultant will carry out the following responsibilities:

• Analyse evidence from investigations;
• Draft Sections of the International Co-Prosecutors final submissions;
• Provides advice to other staff members of the Office of the Co-Prosecutors in regards to relevant evidence;
• Performs extensive factual research and analysis;
• Perform legal research and analysis;
• Draft portions of motion and appeal filings in Cases 003 and 004 as, needed and as assigned;
• Performs other duties as assigned.

INSTITUTIONAL ARRANGEMENT REPORTING AND SUPERVISION
The Legal Consultant will work as a member of the Office of the Co-Prosecutors. He/She will report to the Deputy Co-Prosecutor who will be the designated Project Manager for this project.

DURATION OF ASSIGNMENT
The assignment will be for a total duration of approximately two months, subject to satisfactory performance. The assignment shall commence on the earliest possible opportunity due to immediate need.

DUTY STATION
The position will be located in Phnom Penh, Kingdom of Cambodia.

Minimum Qualifications of the Individual Contractor

Education: University degree in law.

Experience: 2-3 years of relevant working experience.

Competencies:

Language: Fluency in English (both oral and written) is required. Working knowledge of French and/or Khmer is desirable.
